We discuss a disability insurance case handled by us, involving a former wellhead technician who suffered from severe degenerative spinal conditions (cervical and lumbar) and had undergone three back surgeries and a motorcycle accident.
Despite clear medical evidence of worsening health, Prudential (the insurer) denied his long-term disability claim four times, arguing he could perform a sedentary job. Each time, the lawyers appealed, providing detailed medical reports, vocational assessments, and Social Security findings, eventually succeeding after the fourth appeal.
We criticize Prudential for its repeated denials, emphasizing that degenerative diseases don’t improve and that the client had a strong work ethic, proven by his multiple returns to work after surgeries. We highlight this case as an example of why persistence in appealing wrongful disability denials is essential and encourage others in similar situations to seek experienced legal help.
